Martin D. Fern

Martin Fern, a partner in the business and tax department of Silver & Freedman was interviewed about franchising for American Airline's Forbes Business & Technology Channel for the World Business Monitor Show.

Mr. Fern chairs the firm’s New Media, Technology and Intellectual Property Group. He brings more than 35 years of experience dealing with complex corporate and strategic business issues. He is an internationally recognized authority on franchising and licensing. Mr. Fern’s practice emphasizes new media, technology, licensing and franchising, and his clients include large multi-international corporations, medium-size companies and entrepreneurial stage ventures.

Mr. Fern is a prolific writer and the author of leading law treatises in his practice areas. Among them are "Warren’s Forms of Agreements," an eight-volume treatise published by Lexis-Matthew Bender, the leading international law book on the subject of negotiating and drafting business contracts. He is co-author of the three-volume "Franchising Law," published by STP and CCH, the most widely referred to treatise on franchising law. He also authored "Establishing and Operating Under a Franchise Relationship," a Business Monograph Series published by Lexis-Matthew Bender.

Mr. Fern has also written articles that have appeared in national publications on the law of contracts, intellectual property, franchising and technology. He is a frequent speaker at legal and business conferences.

Mr. Fern currently serves on the California Franchise Legislation Committee. He is a past Chair of the Franchise Law Committee of the American Bar Association, the ABA liaison to the Uniform Laws Committee considering the adoption of a Uniform Franchise Law, and a member of the Legal and Legislative Affairs Committee of the franchise trade association, the IFA.

Prior to joining Silver & Freedman, Mr. Fern was a partner at Luce, Forward, Hamilton & Scripps, LLP. He also was general counsel of MGM International. Mr. Fern received a bachelor's degree from the City University of New York, and his juris doctorate, cum laude, from the School of Law at New York University. Mr. Fern is admitted to practice in New York and California.
