Fred Cohen
Fred Cohen is a principal in the litigation group of Goldgerg Kohn of Chicago with significant experience in a broad range of business disputes. He has extensive experience litigating patent and trademark infringement matters, class action, health care matters, business tort cases, e-commerce issues and state and local tax challenges. He is an adjunct professor of intellectual property litigation at the Chicago-Kent College of Law, and he is on the advisory board of The Licensing Journal.
Mr. Cohen has represented Exelon Corp. and its subsidiary Commonwealth Edison Co. for more than 10 years in a variety of complex litigation matters including a lawsuit challenging the annexation of one of Exelon's nuclear power plants to a municipality, and in a series of cases regarding the valuation of Exelon's nuclear and fossil-fueled generating stations.
Mr. Cohen represents Nextel West Corp. in several class action matters, including one involving a class composed of customers in 17 states. He also represents Philip Morris USA as regional counsel in protecting the famous Marlboro trademarks from counterfeiters in a host of litigation matters.
Mr. Cohen also has represented clients in a variety of patent disputes in the areas of digital signal processing, mechanical devices and home health and beauty care products.
Mr. Cohen has brought suit against one of the major accounting firms for malpractice in connection with his client's purchase of a corporation.
On a pro bono basis, Mr. Cohen represents a class of hundreds of thousands of children on Medicaid against the Illinois Department of Public Aid. That case, which is scheduled for a four-week trial in federal court this spring, is the broadest challenge in history to a state's administration of the Medicaid Act under the "Equal Access" and "EPSDT" provisions. He previously represented Marva Paull, who ran for judge of the Circuit Court of Cook County, challenging the constitutionality of an election practice that historically has thwarted the campaigns of candidates who were not "slated" by the Democratic Party. After a successful jury verdict, the unconstitutional practice has disappeared.
Drawing from his wide-ranging practice, Mr. Cohen writes and speaks on topics from general litigation issues to subjects on intellectual property, constitutional limitations on interstate taxation and the deregulation of the electric industry.
